1. Service Description

ConnectMap is a crowdsourced internet connectivity mapping and analytics platform. Our service allows users to:

• Run connectivity tests (speed, latency, signal strength) via mobile app or web interface.
• View aggregated, anonymized data on interactive maps.
• Download datasets and reports for research and planning purposes.
• Access APIs (Professional/Enterprise plans) to query connectivity data programmatically.

ConnectMap is provided on an "as-is" basis. We strive for 99% uptime but do not guarantee service availability.

2. Account Registration & Eligibility

Eligibility: You must be at least 13 years of age to create an account. If you are under 18, you represent that you have parental consent.

Registration Information: You agree to provide accurate, complete information and keep it up to date. You are responsible for maintaining the confidentiality of your password and account.

Account Responsibility: You are responsible for all activity under your account. You agree to notify us immediately of any unauthorized access.

Account Termination: We reserve the right to suspend or terminate accounts that violate these terms or our acceptable use policy.

3. User Conduct & Acceptable Use

You agree not to use ConnectMap to:

• Violate any applicable laws, regulations, or third-party rights.
• Submit fraudulent, malicious, or false data or information.
• Attempt to gain unauthorized access to our systems or networks.
• Harass, threaten, defame, or discriminate against other users.
• Spam, phishing, or distribute malware through the service.
• Reverse-engineer, decompile, or attempt to discover source code or proprietary algorithms.
• Use automated bots or scripts to generate fake measurements or spam the API.
• Resell or redistribute data without a commercial license agreement.
• Impersonate another user or misrepresent your identity or affiliation.
• Violate intellectual property rights of ConnectMap or third parties.

Violations of this section may result in account suspension or legal action.

4. Intellectual Property Rights

ConnectMap IP: All content, design, code, and systems of ConnectMap are proprietary. You receive a limited, non-exclusive license to use the service for your personal or research purposes.

Published Data: Aggregated datasets are published under a Creative Commons Attribution 4.0 International License (CC BY 4.0). You may use published data for any purpose, including commercial, provided you attribute ConnectMap.

User Content: Any content you contribute (measurements, comments, feedback) grants ConnectMap a worldwide, perpetual, royalty-free license to use it for improving our service and publishing research.

Trademarks: "ConnectMap" and related logos are trademarks of ConnectMap. You may not use them without permission.

5. Data & Measurement Accuracy

No Warranty: While we employ rigorous validation, connectivity measurements are subject to variability based on device, environment, and network conditions. We do not warrant the accuracy of any individual measurement.

Aggregate Data: Published maps and datasets represent best-effort aggregations. Historical data may be revised if errors are discovered.

Your Responsibility: Do not rely on ConnectMap data alone for critical infrastructure or policy decisions. Conduct independent verification where feasible.

API Accuracy: API responses are generated from our databases in real time. We are not liable for errors in API output beyond our control.

6. Limitations of Liability

Disclaimers: ConnectMap is provided "as-is" without warranties. We disclaim all warranties of merchantability, fitness for a particular purpose, and non-infringement.

Limitation of Damages: Except where prohibited by law, ConnectMap and its officers, employees, and agents will not be liable for:

• Indirect, incidental, consequential, special, or punitive damages.
• Loss of profits, revenue, data, or use.
• Business interruption or loss of business opportunity.

Liability Cap: Our total liability to you for any claim arising from these terms or your use of ConnectMap will not exceed the greater of (a) $100 USD or (b) the total amount you paid us in the 12 months prior to the claim.

Exceptions: Nothing in these terms limits our liability for fraud, gross negligence, or violations of law that cannot be limited.

7. Indemnification

You agree to indemnify, defend, and hold harmless ConnectMap, its officers, employees, and agents from any claims, damages, losses, or expenses (including attorney fees) arising from:

• Your use of ConnectMap in violation of these terms.
• Your violation of any laws, regulations, or third-party rights.
• Data or content you submit that infringes on intellectual property or privacy rights.
• Your interaction with other users or third-party services.

8. Service Availability & Updates

Uptime: We aim for 99% uptime but do not guarantee uninterrupted service. Maintenance windows may occur with notice.

Updates: We may update, modify, or discontinue features with notice. Material changes to core functionality will be announced via email and in-app.

Service Discontinuation: If we discontinue service, we will provide 30 days' notice and make data available for export.

9. Data Privacy & Security

Please see our Privacy Policy for details on how we collect, use, and protect your data. By using ConnectMap, you agree to our privacy practices.

Your Responsibility: While we employ encryption and security best practices, no system is 100% secure. Do not transmit sensitive personal information via ConnectMap that you would not want exposed.

10. Third-Party Links & Content

ConnectMap may link to third-party websites or integrate third-party services. We are not responsible for the accuracy, legality, or content of third-party sites. Your use of third-party services is governed by their terms and privacy policies.

11. Pricing & Payment (if applicable)

Free Tier: Free access is provided at our discretion and may be limited or discontinued.

Paid Plans: Pricing is displayed on the website. Charges are billed monthly in arrears unless otherwise stated.

Cancellation: You can cancel your subscription anytime. No refunds are provided for partial months, but you retain access until the billing period ends.

Billing Disputes: Contact us within 30 days of a billing error to dispute charges.

Payment Methods: We accept credit/debit cards via secure payment processor. You represent that payment information is accurate and authorized.

12. Dispute Resolution & Arbitration

Informal Resolution: Before pursuing legal action, contact [email protected] to attempt resolution in good faith.

Governing Law: These terms are governed by the laws of California, USA, without regard to conflict of law principles.

Arbitration: Any dispute arising from these terms or your use of ConnectMap will be resolved by binding arbitration in California, unless you opt out within 30 days of first agreeing to these terms.

Class Action Waiver: You agree to arbitrate on an individual basis and waive the right to participate in class action or collective litigation.

13. Modifications to Terms

We may update these terms occasionally. Material changes will be announced via email and in-app notification. Your continued use after changes signifies acceptance of the updated terms.

14. Severability

If any provision of these terms is found invalid or unenforceable, that provision will be severed and the remaining terms will remain in effect.

15. Entire Agreement

These terms, along with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and ConnectMap regarding use of the service.
